Notarial Functions and Expertise in Italy

The term notary public only refers to common law notaries and should not be confused with civil law notaries. Civil law notaries, or Latin notaries, are lawyers of non contentious private civil law who draft, authenticate, and record legal instruments for private parties, provide legal advice and give attendance in person, and are vested as public officers of the Italian Republic. Civil law notaries are highly-trained, licensed practitioners providing a full range of regulated legal services, and whereas they hold a public office, they nonetheless operate in private practice. They receive the same education as attorneys at civil law. They retain and keep a minute copy of their instruments in notarial protocols and archives. Furthermore, notaries in Italy are very well known as the best counsels and advisors on the legal market for identifying legal issues and providing legal guidance aimed at finding tailored solutions. Such acknowledgement is due to the fact that Italian notaries are first of all eminent and prominent jurisconsults (similarly to judges and academics) who continuously study, develop and apply the law. This is why they are thought of as amicable settlement magistrates, practising preventive justice.
